Testing a retail-tax switch

Assembly Bill 76 required a study of replacing wholesale cannabis taxes with higher retail taxation. The subcommittee presented its report at September 14’s advisory meeting; neither the mandate nor the presentation changed tax rates. [1] [2]
At 12–15% retail rates, the report estimates $11–30 million extra receipts against roughly $21 million less education revenue. Not every rate balances that loss. [3]
It assumes wholesale base prices would not immediately fall, so tax removal is no promise of cheaper purchases. It does not recommend abolition; regulation and local distributions also need addressing. [3]
That assumption matters because a wholesale-tax repeal would change the tax base before retailers set final shelf prices. The model describes a fiscal scenario, not a tested price change in Nevada stores.
The education effect is equally important: the report’s estimated loss is tied to the existing wholesale allocation, so a retail replacement would need a separate decision about how schools are funded.
The meeting also leaves implementation questions open, including the rate lawmakers would choose and how local-government and regulatory costs would be protected. Those questions cannot be answered by the scenario table alone.
