NHTSA’s Cybercab audit asks how a driverless design meets safety rules

The agency opened a certification inquiry after the Austin deployment; a later memorandum moved Tesla’s response deadline to October 30.

The National Highway Traffic Safety Administration announced a Tesla Cybercab certification inquiry on September 4, 2026, following commercial deployment of the driverless vehicle in Austin, Texas. The agency said it was examining Tesla’s certification that the vehicle meets applicable federal safety standards. [1]

In the United States, vehicle manufacturers certify their own compliance with federal motor-vehicle safety standards, while NHTSA can investigate the basis for those certifications. The agency’s opening document estimated the inquiry population at 1,000 vehicles and described the Cybercab as lacking permanently attached conventional manual controls including a steering wheel and pedals. [2]

That design makes the scope of existing rules central to the inquiry. The opening record says NHTSA planned to examine the process and technical data Tesla relied on, including whether the company concluded particular standards did not apply. Opening an audit is not, by itself, a finding of a violation or a recall. [2]

NHTSA issued a special order on September 10 seeking information. A September 29 agency memorandum says Tesla sought eight additional weeks and that the agency granted 30 days, moving the response deadline from September 30 to October 30, 2026. [3]

The distinction matters for riders and people sharing the road: certification, regulatory review and a proven safety outcome are different things. The public records cited here establish the inquiry and its response schedule; they do not establish the agency’s eventual conclusion or independently test the vehicle. [1]
